Florida Passes New Restrictions on Gestational Carrier Agreements – ASRM

“Governor Ron DeSantis (R-FL) has signed an anti-gestational carriers act into law in Florida. This notable piece of legislation is part of a broader, ongoing attack on this form of therapy. Dear Florida members,
We want to alert you to a bill that was signed into law by Governor DeSantis this week, CS/CS/CS/HB 905, or the ‘Foreign Interference Restriction and Enforcement (FIRE) Act.’
The law imposes restrictions on adoption and gestational carrier agreements that take place in Florida, including:
The prohibition of preplanned adoption agreements if:
1. The volunteer mother is a citizen or resident of a foreign country of concern (these are listed as China, Russia, Iran, North Korea, Cuba, Venezuela, and Syria)
2. Either the intended father or intended mother is a citizen or resident of a foreign country of concern
Gestational carrier agreements are similarly prohibited if ‘any party to the contract is a citizen or resident of a foreign country of concern.’
The ASRM Office of Public Affairs opposed this and similar measures and worked with stakeholder organizations in Florida throughout the session to limit these and other restrictions on reproductive medicine. Though we are pleased that the version of the Fire Act that was signed into law is a much less punitive model, we do know that this could affect your practice and patients.
